terms of service
Article 1: Scope
These terms and conditions apply to customers who use the shopping site (hereinafter referred to as the "Official Online Store") provided by ViaPordo Inc. (hereinafter referred to as the "Company") and customers who purchase our products (hereinafter referred to as the "Customer"). If you use the Official Online Store, your agreement to these terms and conditions is a prerequisite.
Article 2: Changes to the Terms
If the change to these terms and conditions is in the general interest of our customers, we may change these terms and conditions without the prior consent of our customers. Changes to other terms and conditions shall be in accordance with Article 548-4, Paragraph 1, Item 2 of the Revised Civil Code, and customers who do not wish to have the changed provisions applied shall be given the right to cancel or a sufficient grace period shall be set between the notification of the change and its application.
Article 3: Suspension or interruption of service provision
We may, without prior consent from customers, suspend or stop the service of the Official Online Store to carry out maintenance and inspections, etc., in order to keep the Official Online Store in good operating condition or for other reasons.
Even if any disadvantage occurs to the customer during that time, the Company shall not be held liable in any way.
Article 5: Newsletter Membership
Customers who have registered to receive our newsletter using the form specified by our company are considered "newsletter members." When registering as a member, you will be asked to register your email address, but if there are any changes to the information you have provided, you must promptly re-register or revise the information using the form specified by our company.
Article 6: Order changes and cancellations
In principle, after an order is confirmed by the customer, the contents of the ordered product cannot be changed. Furthermore, orders can only be canceled before the product is prepared for shipment. The procedures for canceling an order will follow our designated form.
Article 7: Return and exchange of products
If the delivered product is found to be damaged, soiled, defective, or the wrong product or quantity, you must notify us using our designated form within 7 days of receiving the product. After notifying us, you must follow the instructions of our customer support regarding the procedure. In addition, we do not accept returns or exchanges of products for personal reasons. Please note that the return and exchange procedures must be carried out by the purchaser themselves, regardless of whether the product is a gift item or not.
In addition, returns and exchanges of products purchased from our official online store can only be accepted at the official online store, and returns and exchanges of products purchased at our physical stores can only be accepted at the store where the product was purchased.
Article 8: Delivery of Products
After you place an order, regular products will be delivered within 3 business days of the order, excluding weekends and holidays. For pre-ordered products, we will follow the announcements regarding delivery dates and times on the product details page, blogs, various advertisements, etc. However, delivery may take longer during busy periods in logistics, such as gift seasons and sales periods.
We shall not be liable for any inconvenience or damage suffered by customers due to delivery delays caused by natural disasters, infrastructure problems, delivery company circumstances, or other reasons not attributable to our company.
Article 9: Shipping charges, cash on delivery fees and price revisions
We will charge customers a flat rate of 550 yen (tax included) for shipping nationwide and a flat rate of 330 yen (tax included) for cash on delivery fees. In addition, we reserve the right to revise the prices of shipping fees, cash on delivery fees, and other products without prior consent from customers in order to keep up with market prices or for reasons such as rising material costs.
Article 10: Prohibited acts
You shall not do the following:
(1) Any act violating laws, regulations, court rulings, decisions or orders, or legally binding administrative measures
(2) Any act that may be contrary to the public order or good morals.
(3) Any act that infringes the copyrights, trademarks, patents, or other intellectual property rights, reputation rights, privacy rights, or other legal or contractual rights of the Service or any third party.
(4) Impersonating the Service or a third party or intentionally disseminating false information
(5) Falsifying customer information
(6) Any illegal acts using the Service
(7) Any act that causes damage to the Service
(8) Any act that interferes with the Service or the Operator’s operations.
(9) Any act of providing benefits to antisocial forces or any act equivalent thereto
(10) Any act that aids or encourages any of the acts listed in (1) to (9) above.
(11) Any act that the Service reasonably determines to be inappropriate, in addition to those set forth in (1) through (10) above.
Article 11: Resale, sales on auction sites, etc.
We prohibit the resale of products sold in our official online store and physical stores, the listing and sale of products on auction sites, preparation for such activities, and other profit-making activities. We will not accept warranty registrations or repairs for products purchased through any other channels than our official sales channels.
Article 12: Prohibition of Transfer of Rights
You may not transfer your status under these Terms and Conditions or your rights and obligations hereunder, in whole or in part, to a third party without our prior written consent.
Article 13: Handling of Personal Information
We will handle your personal information appropriately in accordance with our personal information protection policy.
Article 14: Severability
Even if any provision or part of any provision of these Terms and Conditions is determined to be invalid or unenforceable pursuant to the Consumer Contract Act or other laws and regulations, the remaining provisions of these Terms and Conditions and the remaining part of the provision that is determined to be invalid or unenforceable shall continue in full force and effect.
Article 15: Compensation for Damages
If the Company is liable for damages in connection with the use of this service, the Company shall be liable for compensation up to the total amount of fees paid by the customer to the Company.
Article 16: Governing Law
The establishment, validity, performance and interpretation of these Terms and Conditions shall be governed by Japanese law.
Article 17: Jurisdiction
If a problem occurs between you and our company regarding our official online store, physical stores that sell our products, or other services, the two parties will resolve it through consultation. If the problem cannot be resolved through consultation, the two parties may file a lawsuit or request arbitration, and the summary court or district court with jurisdiction over the location of our head office shall be the exclusive court of first instance.
